		<description>While it is a fair statement that rampant pre-emption of Federal regulation by states is very scary,  I think it is also important to remember that &quot;National Transportation Policy&quot; has failed many stakeholders.  This is particularly true in the LA basin where grandfather exemptions to EPA pollution control regulations have permitted dirty trucks to continue to operate in areas where they do the most damage.  A major reason for new (and delayed) &quot;roadability&quot; rules for chassis fleets is that state and local governments were moving to fix loopholes in Federal regulations.  Many believe that serious problems exist with some trucking labor markets, hence the effort to force use of firm employees.  Lack of effective action by the Federal government has gotten us to this point.  Moving away from this dangerous turn in law will require more effective Federal regulation in areas where clear failures exist.  Without effective Federal leadership, states will continue to fill the void..</description>
